The Medicare Improvements for Patients and Providers Act of 2008 (MIPPA) established new restrictions on how agents can market their Medicare-related products. In order to "protect Medicare beneficiaries from deceptive or high-pressure marketing tactics," many of the new MIPPA restrictions target areas (such as unsolicited calls) that have been a source of abusive sales practices in the past.
Effective September 18, 2008, prior to any marketing appointment, the beneficiary must agree to the scope of the appointment and that agreement must be documented by the plan. When scheduling appointments over the phone, a recording of the call provides the most efficient method of obtaining this documentation.
Who Does MIPPA Apply To?
MIPPA regulations apply to all health plans that sponsor:
- Medicare Advantage (MA).
- Part D Prescription Drug Plans (PDP).
